PROFESSIONAL BUSINESS SUPPLIES LIMITED – TERMS AND CONDITIONS

 

Delivery 

  • Deliveries are free next day unless notified, no minimum order value. Special delivery and express carrier charges are extra

 

Prices

  • The prices contained in any quotation or price list based on conditions ruling at the date thereof.  If any increase however arising in cost of merchandising including but without being limited to any increase in the cost of manufacturing or raw materials. No Prices will be increased on pre agreed contracts without client consultation

 

Value added Tax

  • All prices quoted are exclusive of VAT which will be charged at the rate in force at the time of dispatch

 

Payment Terms

  • Payment for the goods is net monthly after submission of invoices (due by the end of the month after the month in which the goods are invoiced)   Submission means the posting/emailing by the Company of any invoice to a Customer.  Without prejudice to any other rights it may have the Company is entitled to Charge interest before or after judgement at 3.5% per annum above the current rate of Barclays Bank PLC or such other rate (amending or replacing the same), an overdue payment of any invoice amount of any part thereof. Payment can be received via cheque made payable to Professional Business Supplies Limited or via electronic transfer to Barclays Bank PLC, Sort code 20-50-40, Account No. 53042286

 

Title of Goods

  • Notwithstanding delivery and passing of goods, or any other provisions of these conditions, the property in the Goods shall not pass to the Buyer until the Seller has received in cash or cleared funds payment in full of the price of Goods ad all other goods agreed to be sold by the Seller to the Buyer for which payment is due.
  • Until such time as the property in the Goods passes to the Buyer (and provided such Goods are still in existence and have not been sold) The Seller shall be entitled at any time to require the Buyer to deliver up the Goods to the Seller and, if the Buyer fails to do so forthwith, to enter upon any premises of the Buyer or any third party where the goods are stored and repossess the Goods.

 

Shortages, Incomplete orders, Damaged Goods and Non-Delivery

  • All shortages/Damages must be reported within 3 working days of receipt of delivery and in the absence of such notification the Customer shall be deemed to have accepted the Goods.

 

Return of Goods

  • The Customer shall not be entitled to return Goods supplied for credit or rectification except by special arrangement confirmed by the Company in writing.PBS must be notified of returns within 14 days of Delivery. Any request for return of Goods must be in the original packaging, in a resalable condition accompanied by the invoice number and the date on which the goods were delivered.  A handling or restocking charge may be deducted from any credit allowed by the Company where it is established that the reason for the return of the Goods was not due to any error or fault on the part of the Company

 

Warranties and Liability

  • Goods are sold by the Company with the benefit of the manufacturer’s or licensor’s published warranty.  The Goods are not manufactured by the Company (or where the Goods are computer software, the Company does not publish or license the software) and all Goods are subject to the conditions set out below in this clause
  • No liability will be accepted by the Company for any defects arising from wilful damage fair wear and tear negligence misuse abnormal working conditions failure to comply with the Company’s or manufacturer’s published instructions (whether oral or in writing) or any repair or modification of the Goods undertaken without the Company’s prior consent.
  • Until the total price for the Goods is paid by the Customer the Company will be under no obligation in respect of the above warranty.
